1.) Read the terms and conditions on the ticket. This information is critical to any legal claims you may have resulting from an accident, illness or wrongful death. Specific terms, such as the city or state where you have to file your claim, may vary but generally speaking — you will probably be required to give the cruise line a written notice of your claims within six months and file your lawsuit within one year.
2.) Have an “accident plan” in place. Many of the conditions that can cause an accident are temporary or easily fixed. As part of your plan, insist that an official report detailing the incident be prepared by ship personnel. Second, seek medical attention and complain about any part of your body that was injured, no matter how severe or minor. Third, protect your claim by obtaining the names and contact information of passengers or cruise ship employees who may be witnesses or have knowledge about the incident — and by taking photographs of any defective conditions that may have contributed to the accident.
